如何巧妙处理停车场交通事故

常常有客户电话里问我:“Jason,不好了,我在停车场被人撞了或撞刮了别人的车,怎么办?要不要报不报保险?警察为什么不来处理?”面对这样的情形,如何尽可能的避免或规避自己的风险?下面我就此来聊聊。

停车场的事故处理跟平时交通道上发生事故的处理是有区别的:停车场事故的责任判断取决于你的车是否在移动,你是否拥有路权等。要知道停车场通常警察是不来的,也就是说一切证据需要你自己提供。所以,收取证据、旁边证人就显得非常重要。如果没有证据证明你的清白,保险公司就会各打50大板,各半责任了。

下面要点记着了:1. 收集有利于自己的证据,手机拍摄现场等。有证人最好,要留下他们的名字和电话。 2. 不要认错,但需要判断是否自己的责任或自己完全没有责任。如果多少自己都有责任,且损失不大,我会建议选择尽量说服对方私了。3. 如果对方认错,一定要对方写下字条,不然多半对方会事后赖帐。4. 明白你的车是否在动?你是否有路权?

下面是交规中停车场事故责任判断原文,车辆事故和行人事故我们都把它翻译出来,以便于自我分析,希望对你有帮助。

一、Five types of car Accidents In Parking Lots五种常见停车场车辆事故

1. Two drivers back up into each other –  Both cars are moving, so both drivers are responsible for that movement. Neither driver has the right of way. Each is responsible for checking to be sure it is safe to back up before doing so. In this parking lot accident, who is at fault? It is likely both drivers will share fault for the accident.  两辆车同时往后倒出— 因为两辆车都在移动,所以两位驾驶员均需承担责任,二者都没有路权。每个人在挪动车辆之前,都应当观察以确保安全。很可能两位司机都需要为这次事故分担过失。

2. A driver pulls forward out of a space, into the lane of traffic – Both cars are moving so both drivers are responsible. In a parking lot, drivers in the traffic lane have the right of way, so the driver who pulled out of the space is likely the majority at fault in the accident. 从停车位开出,开上交通车道时—在停车场,通常是在车道上行驶的司机拥有路权,所以当发生事故时,通常是从停车位出来的车辆承担主要责任。

3. A driver backs out of a space, into an oncoming car – Because both vehicles are moving, each driver may hold some responsibility. But, the driver in the traffic lane has the right of way.The driver who is backing out is responsible for waiting until it is safe to back out. The driver backing out is likely to be deemed primarily at fault in this parking lot accident.  从停车位倒出,撞上迎面驶来的车辆时—由于两辆车都在移动,所以两个司机都有责任。但是在交通车道上的司机拥有路权,而另一方应该在停车位上等待,直到安全时才移动,所以在这种情况下,从停车位中移出的车辆很可能要承担主要责任。

4. Two cars vying  for the same space collide – While rushing to get a parking space, one car collides with another. Both vehicles were moving, so both drivers have responsibility. Which driver has the right of way? As on a roadway, the driver making a turn across traffic must yield to oncoming traffic. The driver turning left into the parking space is likely the majority at fault in this accident. Of course other factors such as the points of impact on the vehicles, how far each vehicle was into the parking space when the collision occurred, and the speed of the vehicle prior to impact will also affect who is assigned     responsibility for the accident. 两辆车争抢同一车位而发生碰撞—在争抢车位时,两辆车发生擦碰,因为两辆车均在移动,所以双方均有责任,关键在于哪位司机更有路权。在路面上,转向的车辆应当避让直行车辆,所以左转入停车位的司机应当负有更多的责任。当然,其他因素也会产生影响,比如说,车辆碰撞点,碰撞时每辆车辆与停车点的距离,以及碰撞前的车速等等。

5. A car rear-ends another at a stop sign – In this case, only one vehicle is moving. The moving vehicle is generally at fault in this type of accident, whether it occurs in a parking lot or on the roadway. Even if the car in front stops suddenly at a stop sign, the driver in the second car is likely to be at fault. Drivers are expected to provide enough distance between their car and the vehicle in front of them to avoid a rear-end collision. 停牌前发生追尾—这种情况下,通常只有一辆车在移动,因而无论是在停车场或是正常道路上,移动的车辆将承担责任。即使是前面的车辆紧急刹车而发生的碰撞,后面的车辆也很有可能负全责。因为在后面的车辆需要保持足够的车距,以避免发生追尾。

二、Pedestrian Accidents In Parking Lots停车场行人事故

Pedestrians face unique risks ina parking lot. While most parking lot accidents are relatively minor, thoseinvolving pedestrians are an exception, due to the massive size differentialbetween a human being and a car.  行人在停车场面临着独特的风险。虽然大多数停车场事故相对较小,但涉及行人的却是例外,这是由于人与车之间的差异。

Evenat a low speed, an impact between a pedestrian and a car can be fatal or resultin catastrophic injury. 即使是低速行驶,发生在行人和车辆之间的碰撞也会是非常严重甚至是致命的。

Mostaccidents in parking lots involving pedestrians are the fault of the driver. If youare a driver, you are obligated by both law and common decency to drivecarefully, especially when backing out, and keep an eye out for pedestrians.Children can be particularly difficult to spot.停车场中任何牵涉到行人受伤的事故里,一般都是司机的全责。作为司机,不论是从遵循法律或是驾驶礼节的角度考虑,都应当安全驾驶,特别是在倒车时,需要格外警惕行人,尤其儿童,很容易被忽视。

Pedestrianscan sometimes be at fault in an accident, and cell phone use is frequently afactor in such accidents. So when you are walking through a parking lot, stayalert! 也存在一些情况,由行人导致事故的发生,通常都是因为在使用手机。所以,当你在走过停车场时,务必小心!

三、Who’s at fault in a parking lot accident? 责任判断原则

When an accident happens, you can generally use one or two factors to determine whowas at fault in a parking lot accident. 一般而言,以下两点决定谁是责任方:

1. Was the car moving? If only one car is moving, the driver of a moving vehicle is generally the majority at fault in an accident. For example, if your car is legally parked and someone hits it, the other driver is generally at fault. 谁的车辆在发生移动?一般来说,都是车位发生变化的车辆负主要责任。比如说,如果你的车停在车位上,被另一辆车擦碰,则那辆车的司机需要负全责。

2. Which driver had the right of way? If both cars are moving, one car typically has the right of way, based on the pattern or lane of traffic. Of course, if a   driver is going too fast or fails to yield that driver may be at fault. 哪辆车拥有路权?如果两辆车都在移动,那么需要判断哪辆车拥有路权。如果一方开的速度太快,或者没有按规则避让,那么该司机将承担主要责任。

总之,安全开车,多观察,多提防,学会防御性开车避免一切事故的发生,毕竟就算你没有错,也会搭上时间和精力去处理,没有必要。
